Mark Howard KC, the lawyer representing Firststrand, told Britain’s highest court on Tuesday that “the fact commissions are paid by lenders to dealers is not a secret” because it was a practice that had been around for decades. He also sought to dismiss the belief that brokers have a fiduciary duty to their customers. “Even if it is right that in some cases that the dealer says, ‘I’m going to get you the best finance deal’, that still doesn’t make them a fiduciary any more than the salesman who says, ‘This is the best suit you can buy’.”
