English Jurisdiction for Global FRAND Dispute

MediaTek has successfully resisted jurisdiction and service challenges brought by Huawei.

MediaTek brought proceedings against Huawei in the Patents Court, seeking relief which includes determination of a global FRAND licence.

Ranked as the third largest company in Taiwan, MediaTek is one of the top chipset companies in the world. Huawei is headquartered in mainland China, and also has a presence in the chipset market.

The licensing dispute is notable because Huawei wishes to enforce a licence at chipset rather than the usual device level.

Following a three-day hearing, Mr Justice Leech concluded that MediaTek’s claims can go forward to a FRAND trial. He rejected Huawei’s principal arguments which focussed on the East Asian headquarters of both parties, as well as the existence of parallel proceedings brought by Huawei and MediaTek in China.
